Data Deletion Request

This Privacy Policy informs you about the nature, scope, and purpose of the processing of personal data (hereinafter briefly referred to as "data") within our online offer and the associated websites, functions, and content, as well as external online presences, such as our social media profiles (hereinafter collectively referred to as "online offer"). Regarding the terminology used, such as "processing" or "controller," we refer to the definitions in Article 4 of the General Data Protection Regulation (GDPR).

Types of processed data:

Categories of affected persons Visitors and users of the online offer (Hereinafter, we also refer to the affected persons collectively as "users").

Purpose of processing

Used Terminologies "Personal data" are all information relating to an identified or identifiable natural person (hereinafter "data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier (e.g., cookie), or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

"Processing" means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means. The term is broad and includes virtually any handling of data.

"Pseudonymisation" is the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organizational measures to ensure that the personal data are not attributed to an identified or identifiable natural person.

"Profiling" means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict aspects concerning that natural person's performance at work, economic situation, health, personal preferences, interests, reliability, behavior, location, or movements.

The "controller" is the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data.

"Processor" means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

Relevant Legal Bases In accordance with Article 13 of the GDPR, we inform you of the legal bases of our data processing. If the legal basis is not mentioned in the privacy policy, the following applies: The legal basis for obtaining consents is Article 6(1)(a) and Article 7 GDPR, the legal basis for processing to fulfill our services and carry out contractual measures as well as respond to inquiries is Article 6(1)(b) GDPR, the legal basis for processing to fulfill our legal obligations is Article 6(1)(c) GDPR, and the legal basis for processing to protect our legitimate interests is Article 6(1)(f) GDPR. In the event that vital interests of the data subject or another natural person require the processing of personal data, Article 6(1)(d) GDPR serves as the legal basis.

Security Measures In accordance with Article 32 GDPR, taking into account the state of technology, the costs of implementation, and the nature, scope, circumstances, and purposes of the processing as well as the varying likelihood and severity of the risk to the rights and freedoms of natural persons, we take appropriate technical and organizational measures to ensure a level of security appropriate to the risk.

The measures include, in particular, ensuring the confidentiality, integrity, and availability of data by controlling physical access to the data, as well as access to, input, transfer, ensuring availability, and its separation. Furthermore, we have established procedures that ensure the exercise of data subjects' rights, deletion of data, and responses to data compromise. Moreover, we consider the protection of personal data in the development or selection of hardware, software, and procedures, in accordance with the principle of data protection through technology design and through data protection-friendly default settings (Article 25 GDPR).

Cooperation with Processors and Third Parties If, in the course of our processing, we disclose data to other persons and companies (processors or third parties), transmit it to them, or otherwise grant them access to the data, this is done only on the basis of legal permission (e.g., if a transmission of the data to third parties, such as to payment service providers, pursuant to Article 6(1)(b) GDPR is necessary for contract fulfillment), you have consented, a legal obligation provides for it, or on the basis of our legitimate interests (e.g., when using agents, web hosts, etc.).

If we commission third parties to process data on the basis of a so-called "order processing contract," this is done on the basis of Article 28 GDPR.

Transfers to Third Countries If we process data in a third country (i.e., outside the European Union (EU) or the European Economic Area (EEA)) or this occurs in the context of the use of third-party services or disclosure or transfer of data to third parties, this is only done if it is to fulfill our (pre)contractual obligations, on the basis of your consent, due to a legal obligation, or on the basis of our legitimate interests. Subject to legal or contractual permissions, we process or let the data be processed in a third country only if the special conditions of Article 44 ff. GDPR are met. This means, for example, processing is carried out on the basis of special guarantees, such as the officially recognized determination of a data protection level equivalent to the EU (e.g., for the USA through the "Privacy Shield") or compliance with officially recognized specific contractual obligations ("standard contractual clauses").

Rights of Data Subjects You have the right to request confirmation as to whether the data in question is being processed and to information about this data, as well as further information and a copy of the data in accordance with Article 15 GDPR.

According to Article 16 GDPR, you have the right to request the completion of data concerning you or the correction of incorrect data concerning you.

In accordance with Article 17 GDPR, you have the right to demand that relevant data be deleted immediately, or alternatively, according to Article 18 GDPR, to demand a restriction on the processing of the data.

You have the right to demand that the data concerning you, which you have provided to us, be received in accordance with Article 20 GDPR and to demand their transmission to other responsible parties.

Furthermore, according to Article 77 GDPR, you have the right to file a complaint with the competent supervisory authority.

Right to Withdraw You have the right to withdraw consents granted according to Article 7(3) GDPR with effect for the future.

Right to Object You can object to the future processing of your data in accordance with Article 21 GDPR at any time. The objection can be made in particular against processing for direct marketing purposes.

Cookies and Right to Object in Direct Marketing "Cookies" are small files that are stored on users' computers. Different information can be stored within the cookies. A cookie primarily serves to store information about a user (or the device on which the cookie is stored) during or after their visit within an online offer. Temporary cookies, or "session cookies" or "transient cookies", are cookies that are deleted after a user leaves an online offer and closes their browser. Such a cookie can store, for example, the contents of a shopping cart in an online shop or a login status. "Permanent" or "persistent" cookies are cookies that remain stored even after the browser is closed. For example, the login status can be saved when users visit it after several days. Likewise, such a cookie can store the interests of users, which are used for reach measurement or marketing purposes. "Third-party cookies" are cookies offered by providers other than the person responsible for running the online offer (otherwise, if they are only its cookies, they are called "first-party cookies").

We may use temporary and permanent cookies and clarify this in our privacy policy.

If users do not want cookies to be stored on their computer, they are asked to disable the corresponding option in the system settings of their browser. Stored cookies can be deleted in the system settings of the browser. Excluding cookies can lead to functional restrictions of this online offer.

A general objection to the use of cookies used for online marketing purposes can be declared for a variety of services, especially in the case of tracking, via the US site http://www.aboutads.info/choices/ or the EU site http://www.youronlinechoices.com/. Furthermore, the storage of cookies can be achieved by turning them off in the browser's settings. Please note that in this case, you may not be able to use all functions of this online offer.

Deletion of Data The data processed by us will be deleted or its processing restricted in accordance with Articles 17 and 18 GDPR. Unless explicitly stated in this privacy policy, the data stored by us will be deleted as soon as it is no longer required for its purpose and the deletion does not conflict with any statutory storage obligations. If the data are not deleted because they are required for other and legally permissible purposes, their processing will be restricted. That is, the data is blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax reasons.

According to legal requirements in Germany, storage in particular for 10 years according to §§ 147 Para. 1 AO, 257 Para. 1 Nr. 1 and 4, Para. 4 HGB (books, records, management reports, accounting documents, trading books, documents relevant for taxation, etc.) and 6 years according to § 257 Para. 1 Nr. 2 and 3, Para. 4 HGB (commercial letters).

According to legal requirements in Austria, storage is required in particular for 7 years according to § 132 Abs. 1 BAO (accounting documents, receipts/invoices, accounts, receipts, business papers, statement of income and expenses, etc.), for 22 years in connection with real estate and for 10 years for documents related to electronically supplied services, telecommunications, broadcasting and television services provided to non-entrepreneurs in EU Member States and for which the Mini-One-Stop-Shop (MOSS) is used.

Registration Function Users can create a user account. As part of the registration process, the required mandatory information is communicated to the users and processed based on Art. 6 Para. 1 lit. b GDPR for the purposes of providing the user account. The processed data includes in particular the login information (name, password, and an email address). The data entered during registration are used for the purposes of using the user account and its purpose.

Users may be informed by email about information relevant to their account, such as technical changes. If users have terminated their account, their data with respect to the user account will be deleted, subject to any legal obligation to retain this data. It is the users' responsibility to secure their data upon termination before the end of the contract. We are entitled to irretrievably delete all data stored during the contract period.

Use of Registration and Login Functions and User Account As part of using our registration and login functions as well as the use of the user account, we store the IP address and the time of the respective user action. The storage is based on our legitimate interests, as well as the users' interests in protection against misuse and other unauthorized use. This data is not transferred to third parties unless it is necessary to pursue our claims or there is a legal obligation in accordance with Art. 6 Abs. 1 lit. c GDPR. IP addresses are anonymized or deleted no later than 7 days.

Comments and Contributions When users leave comments or other contributions, their IP addresses may be stored based on our legitimate interests within the meaning of Art. 6 Para. 1 lit. f. GDPR for 7 days. This is for our safety in case someone leaves illegal content in comments and contributions (insults, prohibited political propaganda, etc.). In this case, we can be prosecuted for the comment or contribution and are therefore interested in the author's identity.

Furthermore, we reserve the right to process users' data for spam detection on the basis of our legitimate interests according to Art. 6 Para. 1 lit. f. GDPR.

Data provided in the context of comments and contributions will be stored by us permanently until users object.

Comment Subscriptions Users can subscribe to follow-up comments with their consent according to Art. 6 Para. 1 lit. a GDPR. Users will receive a confirmation email to verify they are the owner of the email address entered. Users can cancel ongoing comment subscriptions at any time. The confirmation email will contain instructions on how to withdraw consent. For the purposes of proving users' consent, we store the signup time along with the users' IP address and delete this information when users unsubscribe from the subscription.

You can cancel the receipt of our subscription at any time, i.e., withdraw your consents. We may store the unsubscribed email addresses for up to three years based on our legitimate interests before we delete them to be able to prove a previously given consent. The processing of this data is limited to the purpose of a possible defense against claims. An individual request for deletion is possible at any time, provided the former existence of consent is confirmed.

Akismet Anti-Spam Checking Our online offer uses the service "Akismet", offered by Automattic Inc., 60 29th Street #343, San Francisco, CA 94110, USA. The use is based on our legitimate interests within the meaning of Art. 6 Para. 1 lit. f) GDPR. With the help of this service, comments of real people are distinguished from spam comments. All comment details are sent to a server in the USA, where they are analyzed and stored for comparison purposes for four days. If a comment has been classified as spam, the data will be stored beyond this time. This data includes the name entered, email address, IP address, comment content, referrer, information about the browser used, the computer system, and the time of entry.

Users are welcome to use pseudonyms or to refrain from entering their name or email address. You can prevent the transfer of data completely by not using our comment system. That would be a shame, but unfortunately, we do not see any alternatives that work as effectively.

Contacting Us When contacting us (e.g., via contact form, email, telephone, or through social media), the user's details are processed for handling the contact request and its processing according to Art. 6 Para. 1 lit. b) GDPR. User information may be stored in a Customer-Relationship-Management System ("CRM System") or comparable request organization.

We delete the requests if they are no longer required. We review the necessity every two years; furthermore, the legal archiving obligations apply.

Hosting and Email Sending The hosting services we use serve to provide the following services: infrastructure and platform services, computing capacity, storage space and database services, email sending, security services, and technical maintenance services that we use for the purpose of operating this online offer.

In this context, we, or our hosting provider, process inventory data, contact data, content data, contract data, usage data, meta and communication data of customers, prospects, and visitors of this online offer based on our legitimate interests in an efficient and secure provision of this online offer according to Art. 6 Para. 1 lit. f GDPR in conjunction with Art. 28 GDPR (conclusion of contract processing agreement).

Collection of Access Data and Log Files We, or our hosting provider, collect data on every access to the server where this service is located (so-called server log files) based on our legitimate interests within the meaning of Art. 6 Para. 1 lit. f. GDPR. Access data includes the name of the accessed website, file, date and time of access, transferred data volume, notification of successful access, browser type and version, the user's operating system, referrer URL (the previously visited page), IP address, and the requesting provider.

Logfile information is stored for security reasons (e.g., to investigate abusive or fraudulent activities) for a maximum of 7 days and then deleted. Data whose further retention is required for evidence purposes is exempt from deletion until the final clarification of the incident.

Google Tag Manager Google Tag Manager is a solution that allows us to manage so-called website tags via an interface (and thus integrate Google Analytics and other Google marketing services into our online offer). The Tag Manager itself (which implements the tags) does not process any personal data of users. Google Analytics Based on our legitimate interests (i.e., interest in the analysis, optimization, and economic operation of our online offer within the meaning of Art. 6 Para. 1 lit. f. GDPR), we use Google Analytics, a web analytics service provided by Google LLC (“Google”). Google uses cookies. The information generated by the cookie about the use of the online offer by the users is usually transmitted to a Google server in the USA and stored there.

Google is certified under the Privacy Shield Agreement, providing a guarantee to comply with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).

Google will use this information on our behalf to evaluate the use of our online offer by users, to compile reports on the activities within this online offer, and to provide us with further services related to the use of this online offer and the internet usage. In doing so, pseudonymous user profiles can be created from the processed data.

We only use Google Analytics with activated IP anonymization. This means that the IP address of the users is shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there.

The IP address transmitted by the user's browser is not merged with other Google data. Users can prevent the storage of cookies by setting their browser software accordingly; users can also prevent Google from collecting the data generated by the cookie and related to their use of the online offer and the processing of this data by Google by downloading and installing the browser plugin available under the following link: http://tools.google.com/dlpage/gaoptout?hl=de.

The personal data of the users will be deleted or anonymized after 14 months.

Audience Building with Google Analytics We use Google Analytics to display the advertisements placed within Google's and its partners' advertising services, only to those users who have shown an interest in our online offer or who have certain characteristics (e.g., interests in specific topics or products determined by the websites visited) that we transmit to Google (so-called "remarketing" or "Google Analytics audiences"). With the help of the Remarketing Audiences, we also want to ensure that our ads match the potential interest of the users.

Google Adsense with Personalized Ads We use the services of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, (“Google”) based on our legitimate interests (i.e., interest in the analysis, optimization, and economic operation of our online offer within the meaning of Art. 6 Para. 1 lit. f. GDPR).

Google is certified under the Privacy Shield Agreement, providing a guarantee to comply with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).

We use the AdSense service, which allows ads to be displayed on our website and we receive compensation for their display or other use. For these purposes, usage data, such as the click on an ad and the IP address of the users are processed, whereby the IP address is shortened by the last two digits. Therefore, the processing of the user's data is pseudonymized.

We use Adsense with personalized ads. Google draws conclusions about their interests based on the websites visited by users or the apps used and the user profiles created in this way. Advertisers use this information to align their campaigns with these interests, which is beneficial for both users and advertisers. For Google, ads are personalized when collected or known data determine or influence ad selection. This includes, but is not limited to, past searches, activities, website visits, app usage, demographic and location information. This includes demographic targeting, targeting based on interest categories, remarketing, as well as targeting based on customer match lists and audience lists uploaded in DoubleClick Bid Manager or Campaign Manager.

Google AdWords and Conversion Measurement We use the services of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, (“Google”) based on our legitimate interests (i.e., interest in the analysis, optimization, and economic operation of our online offer within the meaning of Art. 6 Para. 1 lit. f. GDPR).

Google is certified under the Privacy Shield Agreement, providing a guarantee to comply with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).

We use Google’s online marketing procedure “AdWords” to place ads in the Google advertising network (e.g., in search results, in videos, on websites, etc.), so they are shown to users who have a supposed interest in the ads. This allows us to display ads for and within our online offer more specifically to present users only ads that potentially match their interests. If a user is shown ads for products he has been interested in on other online offers, this is called “remarketing”. For these purposes, when our and other websites where the Google advertising network is active are accessed, Google directly executes a code and so-called (re)marketing tags (invisible graphics or code, also known as “web beacons”) are integrated into the website. With their help, an individual cookie, i.e., a small file, is stored on the user's device (instead of cookies, comparable technologies may be used). This file notes which websites the user visits, what content he is interested in, and what offers he has clicked on, as well as technical information about the browser and operating system, referring websites, visit time, and other information on the use of the online offer.

We also receive an individual “conversion cookie”. The information obtained with the help of the cookie is used by Google to compile conversion statistics for us. However, we only learn the anonymous total number of users who clicked on our ad and were redirected to a page with a conversion tracking tag. However, we do not receive any information that can be used to personally identify users.

Users' data are processed pseudonymously within the Google advertising network. This means Google does not store and process, for example, users' names or email addresses but processes the relevant data cookie-related within pseudonymous user profiles. Thus, from Google's perspective, the ads are not managed and displayed for a specifically identified person, but for the cookie owner, regardless of who this cookie owner is. This does not apply if a user has explicitly allowed Google to process the data without this pseudonymization. The information collected about users is transmitted to Google and stored on Google's servers in the USA.

Jetpack (WordPress Stats) Based on our legitimate interests (i.e., interest in the analysis, optimization, and economic operation of our online offer within the meaning of Art. 6 Para. 1 lit. f. GDPR), we use the plugin Jetpack (here the subfunction "Wordpress Stats"), which integrates a tool for the statistical analysis of visitor access and is operated by Automattic Inc., 60 29th Street #343, San Francisco, CA 94110, USA. Jetpack uses so-called "cookies," text files that are stored on your computer and that allow an analysis of your use of the website.

The information generated by the cookie about your use of this online offer is stored on a server in the USA. The processed data can create user profiles, which are used only for analysis and not for advertising purposes. Facebook Pixel, Custom Audiences, and Facebook Conversion Within our online offer, based on our legitimate interests in analysis, optimization, and economic operation of our online offer and for these purposes, the so-called "Facebook pixel" of the social network Facebook, which is operated by Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA, or if you are located in the EU, Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Facebook"), is used.

Facebook is certified under the Privacy Shield Agreement, providing a guarantee to comply with European data protection law (https://www.privacyshield.gov/participant?id=a2zt0000000GnywAAC&status=Active).

With the help of the Facebook pixel, Facebook is able to identify visitors to our online offer as a target group for the display of advertisements (so-called "Facebook Ads"). Accordingly, we use the Facebook pixel to display the Facebook Ads we have placed only to those Facebook users who have shown an interest in our online offer or who have certain characteristics (e.g., interests in specific topics or products determined based on the websites visited) that we transmit to Facebook (so-called "Custom Audiences"). With the help of the Facebook pixel, we also want to ensure that our Facebook Ads match the potential interest of the users and are not annoying. Using the Facebook pixel, we can also understand the effectiveness of Facebook ads for statistical and market research purposes by seeing whether users were redirected to our website after clicking on a Facebook ad (so-called "conversion").

Data processing by Facebook is carried out within the framework of Facebook's Data Use Policy. You can object to the collection by the Facebook pixel and use of your data to display Facebook Ads. To set which types of ads are shown to you within Facebook, you can go to the page set up by Facebook and follow the instructions for the settings of usage-based advertising: https://www.facebook.com/settings?tab=ads. The settings are platform-independent, i.e., they are adopted for all devices, such as desktop computers or mobile devices.

You can also object to the use of cookies that serve for reach measurement and advertising purposes via the opt-out page of the Network Advertising Initiative (http://optout.networkadvertising.org/) and in addition the US website (http://www.aboutads.info/choices) or the European website (http://www.youronlinechoices.com/uk/your-ad-choices/).

Bing Ads On the basis of our legitimate interests (i.e., interest in the analysis, optimization, and economic operation of our online offer in the sense of Art. 6 Para. 1 lit. f. GDPR), we use the conversion and tracking tool "Bing Ads" of Microsoft Corporation, One Microsoft Way, Redmond, WA 98052-6399, USA. Microsoft cookies are stored on users' devices to enable an analysis of the use of our online offer by users, provided users have reached our online offer via a Microsoft Bing ad (so-called "conversion measurement"). Microsoft and we can thus recognize that someone clicked on an ad, was redirected to our online offer, and reached a previously determined target page (so-called "conversion page"). We only learn the total number of users who clicked on a Bing ad and were then redirected to the conversion page. No IP addresses are stored. No personal information about the identity of the users is disclosed.
